Update to the mindless assault on Arizona's business!

- BREAKING NEWS -

The Mayor and City Council Fiddle with Arizona
While the City of Sacramento Burns in VIOLENT CRIME!
THE CONSTITUTION - LAW OF THE LAND?

 NOT SO IN SACRAMENTO, CALIFORNIA?
THEY SAID IT TOOK A COURT ORDER TO WIN!

We Play it... YOU Decide!

SHOW DOWN AT CITY HALL - WHO LIED?
Was it Republican Candidate Paul Smith's attention grabbing stunt
promoted by KTKZ's Eric Hogue and former KFBK flamethrower Mark Williams?

For their latest propaganda: http://www.recallsacramento.com

WHAT IS THE CITY OF SACRAMENTO HIDING?
They're breaking the California Constitution's Public Records Act
Fong says "I don't need to consult constituents before I vote while his
fellow members violate the Brown Act and basic Robert's Rules of Order!

WHO ARE WE TO QUESTION GOVERNMENT OR OUR OWN! - Yeah, that's the ticket.

IT'S NOT JUST ABOUT THE ARIZONA BOYCOTT
IT'S A RECALL - LET THE VOTERS DECIDE!

"Congress shall make no law ... abridging the freedom of speech ... or the right of the people peaceably to assemble, and to petition the government for a redress of grievances." These rights in America are guaranteed by the First Amendment to the Constitution.

At High Noon Thursday, June 24, 2010, after having their lawfully issued permit revoked by the City Manager and a City Attorney, the showdown between citizens and local government WAS on!  It took a last ditch effort in the federal courts to uphold our rights.

Across the nation people listened live online to bear witness to what happens when patriots clash with left leaning elected and appointed officials and some of the more radical elements supporting the boycott of Arizona even though this is NOT the focus of the Recall campaign. When logic fails, hate and racism seems to raise its ugly head on both sides. Did the city revoke the permit, knowing it's an invitation for a potential confrontation?

According to rally organizers: The City of Sacramento called at 4:30 pm on Tuesday and rescinded their permit! They are citing a rule an attorney discovered that says they don't issue permits before 5:00pm. They then followed up with a letter stating: "I am writing to inform you that your Application #339091, for June 24, 2010 has been denied based on the following conditions set forth in City Resolution 2005-550:"

Subject: First Amendment spontaneous demonstrations

Mr. Vina and Ms. Teichert: (City Manager and City Attorney respectively)

My question specifically applies to the rational for the denial of a permit for a “RECALL RALLY” in the vicinity of City Hall tomorrow. Would you please clarify the City Code Section(s) considered in arriving at that decision?

We witness many groups of diverse ideologies, engaging in spontaneous demonstrations without benefit of a permit issued by the city. Rarely do we see any enforcement action taken.

Mr. Vina, you may remember our participation in the coalition to protect our citizen’s Constitutional right to redress of grievances to our government at the same time insuring the equal protection of the public’s safety. We defended the wisdom of former City Code § 27.06.130 but lost the argument for reasonable security measures to attach to such spontaneous demonstrations. The new code is cited below. Why would it not apply to the recall rally applicant?

§12.72.170 Application—Waiver of time.

The director shall waive the period for permit applications when the activity is spontaneous or organized on short notice in response to an event of obvious importance such as local grievances or important national events, and the full period for permit application would deprive the activity of immediate response to such an event. The director may waive the period where circumstances make it impractical or unnecessary.

REF: "With respect to the Public Record Act portion of your e-mail, at this time, the City has no list of firms the City intends to cease existing relationships with."

Thank you for your reply to my CPRA request.  The information on Red Flex Traffic Systems was provided promptly by Mr. Hector Barron on Tuesday, June 22, 2010 4:40 PM with CCs to Amy Williams, Gus Vina, Jerry Way and Chief Rick Braziel.

With respect to the balance and meat of my request and your reply “at this time, the City has no list” I wish to modify my request. I request a copy of ANY accounts payable and receivable spreadsheet reports and/or invoices to or from unincorporated firms, governmental agencies and corporations in the State of Arizona the City of Sacramento has sent or received in the last ninety (90) days. I will initiate another request in the future to determine how they city has invoked the boycott called for in the City Council resolution.

To aid you in the compliance with GOVT. CODE §§ 6250 - 6276.48, I can receive the spreadsheet files electronically in any spreadsheet format. (MS Excel for example). If you supply copies of invoices, we will tender reasonable payment to the city as required.

TO DATE? DEAD SILENCE... next step under the law? COURT!

ABOVE THE LAW! Not only does the Mayor and all but one Council member ignore the California Penal Code, they toss their own rules. Listen as well to the sanctions imposed on the sovereign State of Arizona.

CRIMEWATCH WEBMASTER'S POSITION: On the record!

I rise in STRONG OPPOSITION to Agenda Item #25. Arizona Illegal Immigration Legislation SB 1070 !

We have a violent crime problem right here in OUR CITY! We continue to be the most under-policed capital city/county in America. Calling for a boycott against the State of Arizona over their attempt to control growing violent crime from organized criminal non-citizens invading our southern borders is an insult to your constituents!

If the Sacramento City Council bring this matter back and passes it, I call for a BOYCOTT of all future campaign contributions and votes for every member of the Sacramento City Council that votes for a boycott of Arizona! Will you step up and support Sacramento Citizens Community Watch?

46 speakers spoke supporting the boycott of Arizona, including many representing the ACLU, SEIU, NAACP, La Raza, United Farm Workers and others while calling the 21 speakers who oppose the boycott, racists.

I found it ironic, that the first speaker to lead off is none other than a Sacramento celebrity.

Mr. Eastman

I am faced with an ethical challenge Sir. I am asking you to take a few minutes of your time to open a few links and just listen to its content. We start with this: http://crimewatch.us/RECALLemALL.htm

If you do not hear the audio from Eric Hogue open this link: http://crimewatch.us/media/recallrally.mp3

Mr. Eastman, I am a lowly information provider and aside from that, disenfranchised politically. I ask too many question say my critics. I do however, pride myself on being accurate. The message you see and the audio you heard was distributed widely by my Crimewatch.us Network. I am an Oath Keeper Sir; I’m the founder of a national Public Safety Team gathering intelligence on groups we see as opponents of our Constitution. Most are sworn peace officers and officers in the US Military. I was also an Associate Minuteman having had branch offices in Phoenix and Tucson for many years.

While I don’t consider myself deserving of the recognition, I was one of four Townhall.com Citizens of the Year in 2005. I shared that spotlight with then Congressman Mike Pence, The Minutemen and the Iraqi People. All that honor did was put a larger target on my back by the socialist-progressive elected officials in Sacramento. Praise by a progressive newspaper in town did help either: http://crimewatch.us/watchdog.htm

I have said very little to members of our network about the inaccuracy of the headlines I’ve shared only to discover they are false.  I have added one facebook comment as follows: CLICK HERE for video and commentary.

Paul Smith's herculean effort, while well intentioned, failed to deliver what we hoped would be an important weapon and legal precedent against the City of Sacramento. Despite the excellent legal prowess from attorneys David Llewellyn, John Eastman and other co-counsel, the pleading for an Injunction or Restraining Order to keep the City from violating our civil rights was ruled moot by the federal court. Had these patriots been a day or even hours earlier, I have little doubt they would have won the day. God bless you all for trying but as they say, "Close only counts in Horseshoes and hand grenades."

I’m not a legal scholar but I use the law. In the instant case, I’ve filed under GOVT. CODE §§ 6250 - 6276.48 a request for invoices to and from, and a list of all firms the City of Sacramento intends to Boycott. Their response so far is there is no list. BUNK. I am also challenging them on the grounds that City Code §12.72.170 should have been used to allow the First Amendment Recall Rally to proceed without interference. I served on the citizens committee that crafted that code but our side lost the law enforcement safety provisions we felt critical to the mission of protecting both protesters and the public. In my layman’s opinion, their paper resolution on the grand opening of the new city hall has no merit or force of law behind it. Again, no response from the city.

Our cause has nothing to do with a political campaign or a recall effort. But we may have been viewed that way by City Hall. When radio hosts and a candidate announce to the world an injunction was served on the city when it was ruled moot by the court, how does it make the rest of us look? Your thoughts and what’s next?
