IT'S A RECALL - LET THE
VOTERS DECIDE!

rights in America are
guaranteed by the First
Amendment to the
Constitution.
At High Noon Thursday, June
24, 2010, after having their
lawfully issued permit
revoked by the City Manager
and a City Attorney, the
showdown between citizens
and local government WAS on!
It took a last ditch effort in the federal
courts to uphold our
rights.
Across the nation people
listened live online to bear
witness to what happens when
patriots clash with left
leaning elected and
appointed officials and some
of the more radical elements
supporting the boycott of
Arizona even though this is
NOT the focus of the Recall
campaign. When logic fails,
hate and racism seems to
raise its ugly head on both
sides. Did the city
revoke the permit, knowing
it's an invitation for a
potential confrontation?
According to rally
organizers: The City of
Sacramento called at 4:30 pm
on Tuesday and rescinded
their permit! They are
citing a rule an attorney
discovered that says they
don't issue permits before
5:00pm. They then followed
up with a letter stating: "I
am writing to inform you
that your Application
#339091, for June 24, 2010
has been denied based on the
following conditions set
forth in City Resolution
2005-550:"

specifically applies
to the rational for
the denial of a
permit for a “RECALL
RALLY” in the
vicinity of City
Hall tomorrow. Would
you please clarify
the City Code
Section(s)
considered in
arriving at that
decision?
We
witness many groups
of diverse
ideologies, engaging
in spontaneous
demonstrations
without benefit of a
permit issued by the
city. Rarely do we
see any enforcement
action taken.
Mr.
Vina, you may
remember our
participation in the
coalition to protect
our citizen’s
Constitutional right
to redress of
grievances to our
government at the
same time insuring
the equal protection
of the public’s
safety. We defended
the wisdom of former
City Code §
27.06.130 but lost
the argument for
reasonable security
measures to attach
to such spontaneous
demonstrations. The
new code is cited
below. Why would it
not apply to the
recall rally
applicant?
§12.72.170
Application—Waiver
of time.
The
director shall waive
the period for
permit applications
when the activity is
spontaneous or
organized on short
notice in response
to an event of
obvious importance
such as local
grievances or
important national
events, and the full
period for permit
application would
deprive the activity
of immediate
response to such an
event. The director
may waive the period
where circumstances
make it impractical
or unnecessary.

(90) days. I will
initiate another

future to determine
how they city has
invoked the boycott
called for in the

resolution.

Paul Smith's herculean effort, while well intentioned, failed to
deliver what we
hoped would be an
important weapon and
legal precedent
against the City of
Sacramento. Despite
the excellent legal
prowess from
attorneys David
Llewellyn, John
Eastman and other
co-counsel, the
pleading for an
Injunction or
Restraining Order to
keep the City from
violating our civil
rights was ruled
moot by the federal
court. Had these
patriots been a day
or even hours
earlier, I have
little doubt they
would have won the
day. God bless you
all for trying but
as they say, "Close
only counts in
Horseshoes and hand
grenades."
I’m not a legal
scholar but I use
the law. In the
instant case, I’ve
filed under GOVT.
CODE §§ 6250 -
6276.48 a request
for invoices to and
from, and a list of
all firms the City
of Sacramento
intends to Boycott.
Their response so
far is there is
no list. BUNK. I
am also challenging
them on the grounds
that City Code
§12.72.170 should
have been used to
allow the First
Amendment Recall
Rally to proceed
without
interference. I
served on the
citizens committee
that crafted that
code but our side
lost the law
enforcement safety
provisions we felt
critical to the
mission of
protecting both
protesters and the
public. In my
layman’s opinion,
their paper
resolution on the
grand opening of the
new city hall has no
merit or force of
law behind it.
Again, no response
from the city.
Our cause has
nothing to do with a
political campaign
or a recall effort.
But we may have been
viewed that way by
City Hall. When
radio hosts and a
candidate announce
to the world an
injunction was
served on the city
when it was ruled
moot by the court,
how does it make the
rest of us look?
